The term 'Pro-lab Partners' or 'us' or 'we' refers to the owner of the website, Pro-lab Partners Pty Ltd (A.B.N. 50 492 973 793). The term 'you' or 'Customer' refers to the user or viewer of our website, the person, partnership, corporate trustee or corporation identified as such in the purchase order and any other communications, written or verbal.

The use of this website is subject to the following terms of use:

General Usage

The following terms are defined as;

“Hardware” means the information technology hardware supplied to Customer by Pro-lab Partners in accordance with the Customers instructions.

“Services” means those activities, other than the supply of product, undertaken by Pro-lab Partners or its contractors for and as requested by the Customer and includes but is not limited to network integration, licensing and network auditing, and consulting.

“Software” means the program material in object code supplied to Customer by Pro-lab Partners or any part thereof and all related documentation including manuals and

licenses.

“Products” means Hardware, Software, Licenses and any part thereof.

Pricing

Pro-lab Partners will supply the Products and Services at the prices shown on quotes, invoices and our web site. A Goods and Services Tax (GST) is applied to every invoice and will be shown as a separate item on each invoice or quote for Australian purchases.

Shipping

Pro-lab Partners will arrange transportation at Customer's request and all costs so incurred will be charged to Customer in addition to the quoted price if applicable. These costs are not refundable.

Shipping time of 3-5 days may be incurred for some items upon ordering.

Payment

Pro-lab Partners will invoice Customer on dispatch of the Products.

Unless otherwise agreed in writing by Pro-lab Partners, payment in full must be made before dispatch.

In the event that Pro-lab Partners agrees to extend credit terms to Customer, Customer agrees to pay for the Products and Services within the approved payment terms. If the account becomes overdue, in addition to Pro-lab Partners other remedies, the supply of any further Products or Services to Customer is automatically suspended until all overdue accounts are paid and payment terms for any further Products or Services revert to payment before dispatch.

Retention of Title of Goods

Title to the Products will remain vested in Pro-lab Partners until all Products and Services associated with this invoice and all other Products and Services supplied on similar terms by Pro-lab Partners to Customer have been paid for in full.

In the event that Customer fails to pay for the Products and Services in accordance with these terms and conditions, Customer will at Pro-lab Partners request and at Customer's expense deliver the Products undamaged to Pro-lab Partners. Alternatively, Prolab Partners or its agents, may enter any land or building on which the Products are believed to be stored to recover the Products and to take all other necessary steps to enable Prolab Partners to recover the Products. Customer grants Pro-lab Partners all reasonable access rights for this purpose. On recovery of the Products by Pro-lab Partners, but not until then, risk in the Products reverts to Pro-lab Partners.

This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

All trade marks reproduced in this website which are not the property of, or licensed to, the operator are acknowledged on the website.

Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

You may not create a link to this website from another website or document without Pro-lab Partners prior written consent.

Warranty/Manufacturers Warranty

The Products are provided with a Manufacturer's Warranty.

If the Products are in breach of the Manufacturer's Warranty within the Warranty Period or in breach of any other condition or warranty, Customer may contact Pro-lab Partners to obtain a Return Authorisation (RA) number and return the Products.

The Customer acknowledges that the Manufacturer's Warranty is provided on the basis of return to base unless otherwise agreed in writing and the cost of freight for return and re-delivery of the Products will be at Customer's expense unless otherwise agreed in writing between the parties.

If Pro-lab Partners or the manufacturer reasonably determines that the Products are not defective within the terms of any condition or warranty, Customer will be charged for the cost of repairs and handling.

Return of Products

All returns must be unopened and include original factory packaging (foam plastic wrappings, etc.) blank unfilled warranty cards, all instruction booklets and paperwork. Do not deface original factory cartons or packaging in any manner. We will not accept a return if packaging is not in its original condition. Returns on damaged or scratched merchandise will not be accepted.

All returns are subject to testing before any credit may be granted. Products not returned in the same condition as delivered will be refused.

A Restocking Fee may apply to returns and this will be at Pro-lab Partners discretion. A fee of 15% of the invoiced price including GST could be applied to Customer account.

Products that fail within 7 days of invoice are considered DOA (Dead on arrival) and we will replace this item. If the product returned under DOA is found not to be faulty, there will be a ‘No Fault’ fee incurred of 15% of the invoiced price including GST per item.

Limitation of Warranty

Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

Pro-lab Partners and its associates attempt to be as accurate as possible. However, Pro-lab Partners does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. If a product offered by Pro-lab Partners itself is not as described, your sole remedy is to return it in unused condition.

Governing Law

The laws of New South Wales govern these terms and conditions and any dispute shall be referred to the appropriate body in Sydney, NSW, Australia.
